These Terms & Conditions ("Terms") govern your use of helalmiah.com and any services provided by HM Digital Marketing, operated by Helal Miah. By accessing this website or purchasing any service, you confirm that you have read, understood, and agreed to these Terms.
We reserve the right to update these Terms at any time. Continued use of our services after changes constitutes acceptance of the revised Terms.
Our Services
HM Digital Marketing provides the following professional services:
- B2B Email List Building & Lead Generation
- Data Enrichment & Contact Verification
- LinkedIn Prospecting & Research
- Cold Email Strategy & Copywriting
- Web Research & Data Entry
All services are delivered digitally. Service scope, deliverables, and timelines will be agreed upon in writing (via email, Upwork contract, or equivalent) before work commences.
Payment Terms
- Payment is required before work begins for new clients, unless otherwise agreed.
- Accepted payment methods include: Payoneer, PayPal, direct bank transfer, and platform-based payments (Upwork, Fiverr).
- All prices are quoted in USD unless otherwise specified.
- For large projects (>$500), a 50% deposit is required upfront and the remainder upon completion.
- Invoices are due within 7 days of issue. Late payments may incur a 5% monthly fee.
Delivery & Timeline
- Standard delivery is 2–5 business days for lists up to 1,000 contacts.
- Larger projects (>1,000) have timelines agreed in writing before the project starts.
- Rush delivery is available for an additional fee.
- Delivery timelines begin after payment is confirmed and project brief is received.
- Delays caused by incomplete briefs or slow client responses will not be counted against delivery time.
Revisions & Refunds
- 1 free revision is included in all standard projects to correct data within the agreed scope.
- Revisions must be requested within 7 days of delivery.
- Refunds are provided if we cannot deliver the agreed list size or quality, at our discretion.
- Partial refunds may be issued for partial delivery failures after investigation.
- No refunds are available for change-of-mind after delivery.
Data Quality Guarantee
We guarantee:
- All lists are verified using multi-step email validation tools to maximise deliverability.
- If a significant number of contacts are undeliverable, we will work with the client to replace them on a case-by-case basis.
- All data is sourced ethically from publicly available business directories and professional networks.
- We do not use or resell scraped data that violates platform Terms of Service.
The client is responsible for ensuring their use of the delivered data complies with applicable laws (GDPR, CAN-SPAM, CASL, etc.) in their jurisdiction.
Intellectual Property
Upon full payment, the client receives full ownership of the delivered data and reports. All website content, tools, and branding on helalmiah.com remain the exclusive intellectual property of HM Digital Marketing and may not be reproduced without written permission.
Confidentiality
We treat all client project briefs, target market information, and business data as strictly confidential. We will not disclose your project details to third parties without your consent, except as required by law. Clients are also requested to keep pricing and project details confidential.
Limitation of Liability
HM Digital Marketing shall not be liable for:
- Indirect, incidental, or consequential damages arising from use of delivered data.
- Results of cold email campaigns or outreach conducted by the client.
- Changes in email validity after the guaranteed period (30 days from delivery).
- Any losses arising from client misuse of the delivered data.
Our total liability in any dispute shall not exceed the amount paid for the specific project in question.
Prohibited Use
You agree not to use our services or delivered data to:
- Send unsolicited bulk spam in violation of applicable law.
- Harass, threaten, or contact individuals in an abusive manner.
- Resell our delivered data as-is without value-add or our consent.
- Conduct any illegal activity under applicable laws.
Violation of these restrictions may result in immediate termination of services without refund.
Governing Law
These Terms are governed by the laws of Bangladesh, where HM Digital Marketing is based. For disputes involving clients in the EU or UK, applicable consumer protection regulations will also apply. Any disputes shall first be attempted to be resolved through good-faith negotiation.
